The Toms River planning board next month will hear an application that, if approved, would pave the way for a new restaurant in Ortley Beach with apartment on the second floor.
The application before the board covers the property at 1950 Route 35 North, at the corner of 5th Avenue and next to the Sea Wasp luncheonette and Kohr’s Ice Cream properties. According to a plan submitted by attorney Harvey L. York, the applicant, Patsy Aversa, is asking the board to allow the conversion of the building from a multi-family residential building to a mixed use facility with a restaurant on the first floor and a residential apartment on the second floor.
The plan requires variances for front and side yard setbacks and the distance of the refuse area to the building. Normally, the property would require 32 parking spaces, but three are proposed, also requiring variance relief. Another minor variance is required for the positioning of a sign.
The board will hear the application at its Aug. 5 meeting, which will be held at 6 p.m. at the Toms River municipal building on Washington Street.
